By accessing or using the Kreisler music learning platform, operated by Kreisleriana LLC ("Kreisler", "we", "our", or "us") (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.
These Terms apply to all users of the Service, including visitors, registered users, and those who access premium features.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.
To access certain features of the Service, you must create an account. When you create an account, you agree to:
You must be at least 13 years old to use this Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

The Service and its original content, features, and functionality are owned by Kreisler and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You retain ownership of any content you create or upload to the Service, including practice recordings and personal notes. By uploading content, you grant us a limited license to store, process, and display that content as necessary to provide the Service.
Some features of the Service require a paid subscription. Subscriptions are processed by Stripe; we do not store payment card details on our servers.
Your subscription automatically renews until you cancel it. When you subscribe to a monthly plan, your payment method is charged once per month at the then-current price. When you subscribe to an annual plan, your payment method is charged once every twelve months. Each renewal charge is the same as the immediately preceding charge, except after a price-change notice (see below).
If your subscription includes a free trial, you will not be charged during the trial period. At the end of the trial period your payment method is automatically charged the published price for the plan you selected, and the subscription renews on that cadence thereafter, unless you cancel before the trial ends.
You can cancel your subscription at any time, in one click, with no phone call required. Open the Subscription page from your account menu and choose Manage subscription; this opens the Stripe Billing Portal, where the Cancel button ends auto-renewal immediately. There is no separate cancellation form, no email or phone confirmation, and no retention offer gate.
Cancellation takes effect at the end of the current billing period: your access to paid features remains in place until that date, and we do not pro-rate or refund partial periods unless required by law (see Refunds below).
We will give you at least 30 days' written notice by email before any price increase takes effect for your subscription. The notice will state the new price, the date it applies, and how to cancel. You may cancel before the new price takes effect to avoid the increase. If you do not cancel, your continued use of the Service after the effective date constitutes acceptance of the new price.
Subscriptions are non-refundable except where required by applicable law. We may, at our sole discretion, issue a partial or full refund for a billing period in cases of documented service unavailability or billing error. To request a refund, contact support@kreisleriana.com with your account email and the charge in question.
If you reside in the European Union or the United Kingdom, you have a 14-day right of withdrawal from the date of subscription, under the EU Consumer Rights Directive 2011/83/EU and equivalent UK regulations. By starting to use the paid features of the Service before the 14-day period ends, you expressly consent to immediate performance of the contract and acknowledge that you lose the right of withdrawal once the digital service has begun. If you have not yet used the paid features, you may withdraw within 14 days of the subscription start date by emailing support@kreisleriana.com; we will refund the full subscription charge to the original payment method.
For subscribers in California, this section is provided in compliance with California Business and Professions Code ยง17600 et seq. (SB-313 / SB-313.1): all auto-renewal terms are disclosed in clear and conspicuous form above; you affirmatively consent to those terms by completing checkout; we will send you an acknowledgement of the auto-renewal terms by email after subscribing; and you may cancel online at any time through the Manage subscription link without contacting customer service.
If a renewal charge fails, our payment processor will retry the charge over a short window. During that window your subscription enters a past-due state and your access to paid features is suspended. You may restore access at any time by updating your payment method through Manage subscription; your subscription returns to active within seconds of a successful charge.
We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:
Upon termination, your right to use the Service will immediately cease. You may request an export of your data before termination in accordance with our Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
The Service is intended as an educational tool and is not a substitute for professional music instruction. We make no guarantees regarding learning outcomes or musical proficiency.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KREISLER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
Our total liability to you for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Kreisler operates, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the Service will be resolved through binding arbitration, except where prohibited by law.
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date.
Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
